Terms and Conditions

These Terms and Conditions ("Terms") govern the supply of coconuts and related services by The Branded Coconut to any individual or business ("you", "the client") who engages our services. By placing an order or submitting an enquiry, you agree to these Terms.
About Us
The Branded Coconut supplies fresh, diamond-cut young coconuts, including custom branded coconuts, to hotels, restaurants, cafes, bars, and event organisers across Sydney, Wollongong, and Newcastle.
Enquiries & Quotes
Submitting an enquiry or receiving a quote does not constitute a binding order. An order is only confirmed once we have agreed on quantity, pricing, branding details (if applicable), and delivery date in writing (including via email).
Pricing
Pricing depends on order volume, branding complexity, delivery location, and order frequency. All prices are in Australian dollars (AUD) and inclusive of GST unless otherwise stated. We reserve the right to update pricing at any time, though confirmed orders will honour the price agreed at confirmation.
Payment Terms
Payment is invoice-based. An invoice will be issued upon order confirmation or delivery, as agreed with the client, and is payable within [insert number, e.g. 7 or 14] days of the invoice date. We do not process or store payment card details through our website. Late payment may affect the fulfilment of future orders. Any late payment terms (such as interest on overdue amounts) will be disclosed at the time of invoicing if applicable.
Custom Branding
For custom branded coconuts, the client is responsible for supplying artwork or logo files suitable for engraving and for approving a design proof prior to production, where a proof is provided. Once branding has commenced or been produced, orders are not eligible for cancellation or refund due to the custom nature of the product, except where required under the Australian Consumer Law.
The client warrants that they own or have the right to use any logo, trademark, or design submitted for branding, and agrees to indemnify us against any claim arising from unauthorised use of such material.
Delivery
We deliver to Sydney, Wollongong, and Newcastle. Delivery windows will be confirmed at the time of order. As coconuts are a fresh, perishable product, we recommend orders are received and refrigerated (2 to 5°C) promptly upon delivery. Risk in the goods passes to the client upon delivery.
We are not responsible for delays caused by circumstances outside our reasonable control, including but not limited to weather, traffic, or supply chain disruptions, though we will make reasonable efforts to notify you of any delay.
Order Changes & Cancellations
Supply orders: Changes or cancellations should be communicated with as much notice as possible. Recurring supply arrangements may be adjusted with reasonable notice as agreed between the parties.
Event orders: We recommend booking at least 2 weeks in advance. Cancellations made close to the event date, or after custom branding has commenced, may not be eligible for a refund due to the perishable and custom nature of the product, except where required under the Australian Consumer Law.
Freshness & Food Safety
Our coconuts are supplied fresh and handled with reasonable care to maintain quality prior to delivery, including refrigerated storage. Once delivered, it is the client's responsibility to store and handle the product appropriately (refrigerated, 2 to 5°C) and to use it within a reasonable timeframe. We are not liable for spoilage or quality issues arising from improper storage or handling after delivery, except where liability cannot be excluded under law.
Liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (ACL) that cannot lawfully be excluded. To the extent permitted by law, our liability for any breach of a non-excludable guarantee is limited, at our option, to the resupply of the goods or services, or the cost of resupply.
Beyond this, we are not liable for any indirect, consequential, or special loss arising from the supply or use of our products, including loss of profits or reputational damage, except where such liability cannot be excluded under law.
Intellectual Property
All content on our website, including text, images, and branding, remains the property of The Branded Coconut unless otherwise stated. Logos and designs submitted by clients for engraving remain the property of the client and are used solely for the purpose of fulfilling the order.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of New South Wales.
